Article 1 β€” Purpose

Moodator is a web-based professional wellbeing tracking service. It allows users to log daily mental and physical health indicators to generate a personalised barometer and AI-assisted analyses.

Moodator is a prevention and awareness tool. It is not a medical device, does not replace medical diagnosis, and must not be used as such.

Article 2 β€” Access to the service

Access to Moodator is reserved for adults aged 18 or over with a valid Google account. Registration is via Google OAuth authentication. No password is created or stored by Moodator.

Users are solely responsible for the security of their Google account and any consequences of unauthorised access to it.

Article 3 β€” Free trial period

Every new user receives a free trial of 20 days from the date of registration, with full access to all features.

After this period, access is suspended until a paid subscription is taken out (see Terms of Sale). User data is retained for 90 days after trial expiry before automatic deletion.

Article 4 β€” Acceptable use

Users agree to use Moodator lawfully and not to:

  • Attempt to access other users' data
  • Deliberately overload the servers
  • Use the service for commercial purposes without prior agreement
  • Post unlawful, defamatory or third-party-infringing content
  • Use automated tools to collect data

Moodator reserves the right to suspend any account that violates these rules, without notice or refund.

Article 5 β€” Personal data

Moodator collects and processes the following data:

  • Google identifier (pseudonymised)
  • Daily log data (sleep, stress, activity, screen time…)
  • Profile data (occupation, family situation, health habits)
  • Free-text comments entered by the user

Data is stored on secure servers in France only. It is never sold or shared with third parties for commercial purposes.

Users may delete all their data at any time. Deletion is immediate and irreversible.

Article 6 β€” Intellectual property

All elements of the Moodator service (source code, design, logo, content, algorithms) are the exclusive property of Moodator. Any reproduction, even partial, is prohibited without prior written authorisation.

Data entered by the user remains their property. By entering it, they grant Moodator a non-exclusive licence for use strictly within the operation of the service.

Article 7 β€” Limitation of liability

Moodator is provided "as is" and does not guarantee continuous service availability. Moodator cannot be held liable for:

  • Decisions made on the basis of data provided by the service
  • Temporary service interruptions for maintenance or technical incidents
  • Any medical consequences resulting from misinterpretation of results

Article 8 β€” Modification of Terms

Moodator reserves the right to modify these Terms at any time. Active users will be notified at least 15 days before any substantial change. Continued use of the service constitutes acceptance of the revised Terms.

Article 9 β€” Termination

Users may close their account at any time by deleting their data (see Article 5). Moodator may suspend or close any account that violates these Terms.

Article 10 β€” Applicable law

These Terms are governed by French law. Any dispute will be submitted to the competent courts in the jurisdiction of Moodator's registered office.
